 This 35-plus hour multi-session seminar is designed to educate attorneys, law enforcement personnel and medical professionals on some of the latest developments in criminal law.  Topics will cover both judicial and legislative changes, as well as the “in the trenches” view from practicing attorneys, law enforcement personnel and judicial officers.  Sessions will cover recent U.S. Supreme Court cases and Minnesota Appellate and Supreme Court cases, as well as the latest in such areas as computer forensics, elder abuse, immigration and gangs.

9:00- 11:00      Response to Sexual Violence:  Predatory Offenders – Registration & Community Notification

This course will describe the extent of sexual violence and discuss the effectiveness of current strategies to address the issue through registration of predatory offenders and community notification. Developments in predatory offender registration and implications for enforcement and prosecution will be presented.  Community notification requirements will be reviewed and consequences of public notification will be examined.  Alternative strategies to enhance public safety will be explored.                      

 

 11:15-12:30     Grand Jury (Jill Gerber and Dan Vlieger)

  

What is a grand jury and how does it work?  Can the State really indict a ham sandwich?  All attorneys have heard of a grand jury and most have heard the adage regarding indicting a ham sandwich, but many do not really understand the concept of the grand jury or what an indictment actually means.  This seminar will explain the concept of the grand jury and how it works at the State level.  Topics included:  Purpose and function of the Grand Jury; Brief history of its development; Special statutes and rules that apply; Presentation of instructions given to a new Grand Jury panel; What information must you provide to the Grand Jury and a Case Discussion into State v. Aaron Morrow; and Summary of important appellate decisions impacting the Grand Jury function and development

1:15- 2:45        Juvenile interviews and Prosecutions (Jill Fedje and Sgt. Jill McRae)

 

The topic of interviewing juvenile will include basic information about when you can interview juveniles, what are the best practices in determining competency for them to waive their rights. There will be a discussion of what the court looks at in the manner of the interview, the environment of the interview and the experience of the child with the criminal justice system. There will be some cases reviewed to illustrate the application of the law relating to interviewing juveniles

 

 3:00-5:00         Community Prosecution and Policing (Jill Fedje, Kim Bingham, Tony Tedesco and Sgt. Jill McRae)

  

The topic of community policing and community prosecution will be a panel discussion of law enforcement, the St Paul City Attorney’s Office and the Ramsey County Attorney’s Office.  Community prosecution is based on a closer working relationship among law enforcement, local neighborhoods, and prosecution to prevent crime and hold accountable those folks who prey on the community.  The goal is to increase accountability of the offender and build a stronger connection of the citizens to the criminal justice system to increase the quality of life. The topic will include aspects of collaboration, strategies to address chronic offenders, diversion programs and the IL3CP pilot project of intelligence based policing.
